Mifepristone litigation:

Two of the studies cited by Texas Judge in his ruling suspending federal approval of abortion pill mifepristone were retracted on February 5, 2024.

State Ballot Initiatives:

Efforts are underway in multiple states to place abortion-related ballot measures to amend the state constitutions, including:

  • Arkansas: To establish a right to abortion up to 20 weeks, to protect the pregnant individual in life-threatening situations, and in cases of fatal fetal anomalies, rape, and incest (currently gathering signatures)
  • Arizona: To protect abortion until viability and to protect the pregnant individual in life-threatening situations (currently gathering signatures)
  • Colorado: To recognize the right to abortion in the constitution and repealing an existing amendment that prohibits the use of state funds for abortion (currently gathering signatures)
  • Florida: To protect abortion until viability and to protect the pregnant individual in life-threatening situations (pending review with Florida Supreme Court)
  • Iowa: Declaring that the state constitution does not require allocation of public funding for abortion care as well as not recognizing or securing a right to abortion (awaiting vote in state legislature)
  • Maine: To guarantee a right to personal protective autonomy (awaiting Senate vote)
  • Maryland: To guarantee a right to personal protective freedom (on the ballot)
  • Missouri: To establish a right to abortion up to 12 weeks, to protect the pregnant individual in life-threatening situations, and in cases of fatal fetal anomalies, rape, and incest (approved for circulation); protecting reproductive freedom (currently gathering signatures)
  • Montana: To protect abortion until viability (awaiting Montana Supreme Court Review)
  • Nebraska: To establish a fundamental right to abortion until viability and to protect the pregnant individual in life-threatening situations (currently gathering signatures)
  • Nevada: To establish a fundamental right to reproductive freedom (measure paused by District Court)
  • Pennsylvania: To prohibit public funding for abortions or anything related to abortions (awaiting vote in PA legislature)
  • South Dakota: To prohibit abortion only after end of second trimester and to protect the pregnant individual in life-threatening situations (currently gathering signatures)
The following states are considering new laws define individuals based on their reproductive anatomy and would specify an individual be identified as “man” or “woman” if they possess, previously possessed, will possess, or would have possessed a reproductive system that produces, transports, and utilizes eggs or sperm for fertilization and prohibits the use of the term “gender identity”
  • Georgia
  • Iowa
  • West Virginia

State Legislation and Reproductive Medicine

The ASRM Center for Policy and Leadership (CPL) has released reports concerning States' Abortion Laws and their Potential Implications for Reproductive Medicine. Current as of the date of publication, the reports provide an overview of states’ abortion laws, together with analysis of potential implications for reproductive medicine, including IVF.
